The globalization of the offer, or better the possibility to display his own goods in a window open to the public of all the world, with the possibility to execute business transactions without care of states borders, allows new problems arise due to the 'location' of those transactions.

The geographic location rule, on which it is based the international trade, is brought into question by the Net. Then it is not able to locate a certain place in a real area, because we talk about virtual places and virtual addresses.

The domain names do not locate a geographic area , but only a logic one. The famous ".com" can be used by people living all over the world, and even if a first level domain is used, such as ".it" ".fr" ".de", none can guarantee about the place of origin of that domain's user: many reasons, such as fiscal ones, can justify that a company placed in a State act using a domain that refers to a different State.

Moreover, the possibility to use pseudonyms and to take advantage of those services that make messages anonymous, deleting every reference of the sender's address, makes more difficult to locate the geographical area of the transaction.

In this context it is necessary, therefore, to take into consideration the national and international rules which characterize when the Italian jurisdiction can apply in a contentious procedure.
